First things first

Can you sell an inherited property in Spain without accepting the inheritance?

An inherited house sells like any other, but first the inheritance has to be settled: accepted, its taxes paid and registered at the Land Registry (Registro de la Propiedad). Leave it until the end and it delays the sale.

You don’t need to have everything ready to talk to me. Tell me where you are and I’ll tell you what’s missing and in what order.

“Hardly any sale is simple, and an inheritance even less so. If you tell me at the start, I’ll explain all the options and what each one involves before you sign anything.”

Step by step

How do you sell an inherited property in Spain, step by step?

From day one to the signing. Erica helps you with the paperwork at every step.

You tell me about the house

Which house it is, how many heirs there are and where the inheritance stands. I tell you what it’s worth based on what is being paid in its area.

You accept the inheritance

Before a notary, with the will or the declaration of heirs. If one of you lives abroad, they can sign with a power of attorney.

You pay its taxes

Inheritance tax (Impuesto de Sucesiones) and the municipal capital gains tax (plusvalía municipal). The deadline is six months from the death.

You register it at the Land Registry

In the heirs’ names. With that done, the house can be sold without surprises.

We sell it

Photos, buyers, viewings and negotiation. At the notary, each of you receives your share.

Haven't accepted the inheritance yet?You can get the sale ready in the meantime: find out what it's worth, take the photos, sort out the paperwork. I'll tell you how to fit the timings together so you don't lose a buyer.
Between siblings

What if the heirs can’t agree on selling?

It happens a lot: one wants to sell, another wants to keep it and another lives abroad and can’t come over. These are the ways out, and what each one involves.

The simplest

You all sell together

You agree on the price and split the proceeds according to each person’s share. With a serious valuation in front of you, it’s easier to agree.

If someone wants to keep it

One buys out the others

It’s signed at the notary and the benchmark is the market value of the house. I tell you that value so nobody loses out.

The last resort

A judge decides

If there’s no agreement, any of the heirs can ask the court to divide the property. It takes time, and if it ends up at auction it’s hard to get what it’s worth.

The paperwork

What documents do you need to sell an inherited flat in Spain?

If you’re missing one, don’t worry: Erica helps you get it. And if you need a lawyer or a consular procedure, I know who to call.

  • Death certificate
  • Certificate of last wills (certificado de últimas voluntades)It shows whether there was a will and which notary it was made before.
  • Will or declaration of heirs (declaración de herederos)If there was no will, the declaration is made at a notary.
  • Title deed of the house (escritura)Or a Land Registry extract (nota simple).
  • Latest property tax (IBI) receipt
  • NIE for each heirIf any of you is a foreign national. We help you apply for it.
  • Energy performance certificateRequired to sell any home.

Frequently asked questions

Questions about selling an inherited house or flat

Still have a question? Ask me directly.

Can you sell an inherited house without having accepted the inheritance? +

No. First it has to be accepted, its taxes paid and the house registered in the heirs' names. What you can do is get the sale ready in the meantime.

What taxes do you pay when selling an inherited property in Spain? +

For inheriting, inheritance tax (Impuesto de Sucesiones) and the municipal capital gains tax (plusvalía municipal). For selling, the gain between the value declared in the inheritance and the sale price is taxed as income, and there is another plusvalía municipal for the years the house has been yours. We help you work it out before setting a price.

What happens if one of the siblings doesn't want to sell? +

They can buy the others' shares or sell their own. If there's no agreement, anyone can ask the court to divide the property, but it's slow and usually ends at auction. It's nearly always worth sitting down with a serious valuation in front of you.

How much is the house we've inherited worth? +

Answer eight questions and I'll give you a price based on what is really being paid in its area. It helps you sell, and also helps siblings agree.

We live outside Spain. Do we have to come over? +

Not necessarily. You can sign with a power of attorney and we help you with the NIE, the notary and the taxes. Tell us about your case and I'll tell you how I'd handle it.
